A Slice of Pie

 H.R.4437
Back to Full Blog

Have you read anything about this proposed bill? The Border Protection, Anti-terrorism, and Illegal Immigration Control Act. It is frightening to me. It will do nothing to protect against terrorists.

Here is just a sampling of the concerns all of us should have about the proposed act.

Under current law being in the U.S. without valid status is a civil violation, not A CRIMINAL ACT. hr 4437 WOULD MAKE THIS A FEDERAL CRIME. And would define immigration violations so broadly as to include every violation no matter how minor, technical or unintentional. It would also permanently bar the entire undocumented population including 1.6 million children. It will lead to separation of family members who would never be able to to secure lawful immigration status in the U.S.

It greatly expands the definition of "alien smuggling" to anyone trying to assist an immigrant in remaining in or attempting to remain in the U.S. when the "offender" knows the person is in the U.S. unlawfully. This includes social services organizations, refugee agencies, churches, lawyers, concerned citizens. You would be treated and charged the same as smuggling rings. Even family members and charitable workers could face Federal Prison time for assisting undocumented immigrants.

HR 4437 would require the Department of Homeland Security to detain all non-citizens caught along the boarder until they are removed from the U.S. Yes, detention centers! And if those detention centers become to crowded ,which of course they will as they try to remove all undocumented immigrants, then HR 4437 will authorize a contract with state and local jails to detain them. Furthermore criminalizing immigrants and also filling our already over crowded jails!

And get this, Aggravated Felonies are supposed to reserved for the worst and most violent crimes like rape and murder, they carry the most serious immigration consequences. But under HR 4437 even the most minor crimes, usually a misdemeanor, such as drunk driving, assisting an undocumented worker to reside in the U.S., even being in the U.S. without documentation will then be treated as a felony. But see the thing is most of the charges can be retroactive meaning that someone who committed a minor offense 20 years ago that was not a deportable offense then could now be charged with an aggravated felony. And the offense no matter how minor then will trigger the same immigration consequences of a major crime. Mandatory deportation, mandatory detention, disqualification of almost all immigration benefits, permanent banishment from the U.S. with no hope of lawful return. At risk include permanent residents who have lived here lawfully for decades. And because the non-citizen population is so large many American families include both immigrants and citizens this will break up U.S. citizen families with no hope of ever being reunited!

There are many many more unbelievable propositions in this bill.

I urge you to check this bill out for yourselves and if you feel as I do about this proposed act, contact your congressmen and urge them to vote no. I believe we do need to overhaul our immigration laws but not with HR 4437. I think the proposed Kennedy/McCain bill is the right way to go.

You're right, Pie. More goofy xenophobia. (Sigh). I'll write to our primitive congressmen--perhaps they'll listen to reason. Although reason is a foreign country in these parts...

It's a sorry state we've come to. Soon I won't be able to go to Canada (which is closer to me than most of the U.S.) without a passport. I don't know if the "security" laws are stopping terrorists, but they're stopping me.

The current state of affairs, and the affairs of the state just plain worry me...history will look back at this point in time, at the administration, at congress, at the senate, and at the press, and also at US, the PEOPLE,...and it will not be kind in it's accounting. We, the PEOPLE, have the power...we just don't utilize it. But like a giant snowball running downhill collecting more and more snow...how do you stop it at this point, or even start steering it in another direction.? ~J.

Pie, the fingers of Homeland Security are very long and will have a say so in how we live our lives from here on in. I do believe that a Passport is now required to get into Canada. This country will forever be changed in the wake of 911. It was such an awful thing to happen. So very sad...

I'm sure they will amend this bill...it is because there are so m,any people complaining about the illegals to their congressman they constantly go on and on how illegals do not pay taxes, how they can go to any E.R. and get free medical care and then the American citizens end up paying higher health care costs, etc. etc. Blame all the citizens who are constantly going on and on about the illegals. Here we have asses that picket in a town called Farmingville because of all the day laborers if you want to know who is behind all of this look at your neighbors...I personally like all the Latin people I have met I feel they are an asset to society and all the ones I have met are hard workers, kind hearted and intelligent...it's the loudmouth idiots that keep yelling they want them gone. Too bad I see very few people in that town standing next to the illegals when the protestors berate them...I would go there but I live quite far from that town and plus I don't even know when these protests and counter demonstrations take place until that night on the news. Go blame idiot citizens that want illegals out of the country.

Okay, I read it. Another case of throwing the baby out with the bath water. Lots of times it seems the politicians take forever to do anything, then when they do--they go way overboard. Guess I'd better get busy with some letters to my Congressmen. Thanks Pie!

Hi Pie. I'm tired of the terroist/terrify card. Down south there are vigilanties patrolling the borders and up north the border guys run every time a killer is headed their way. Canadian border patrol doesn't carry guns. I think we should start concentrating on making sure people left homeless from Katrina have homes, kids have food and everybody has access to health care. Why have illegal immigrants become such a threat to us? I don't think it has anything to do with terrorism...but I could be wrong. Okay, got all worked up so must calm down. Happy V day Pie. ---debyd

Pie, by the time both the House and Senate vote on this it will be a very different bill. I can't see them doing this thing anymore than they did the Clinton Health Care bill that made so many things felonies.

However, we do have the Supreme court for redress. Once a statute of limitations is up it is up and nothing can change that. There are also so many illegals and too few people to enforce the laws that are on the books that would be contradicted by this bill that it will never pass muster with the court system.

That being said, never stop letting your congressmen and women know what we expect from them. To do what is best for our country.

It also has been proposed and I think passed that we must have our birth certificates, at least in MO to get our liscenses renewed. Our SS cards and other forms of identifications are no longer valid.

Take care. Beth.

What exact purpose does Homeland Security serve? I know what they're /supposed/ to be, but what are they /really/ doing?

I the place where I live (where reason is foreign as my father so eloquently put it) Homeland Security tried to cite some guy who worked for the feds for having anti-war signs on his private vehicle. The paper they printed the story in gave the phone number for the local Homeland Security HQ.

Thanks for the heads up on this. I'm most certainly going to read it. Maybe I can get a few people in my class to write letters to the senators here.

I am so surprised to see that anyone else cares about this issue. I have been following it for a while. I wrote about it in my blog a while back too. This bill is not only a bad bill it is a terrible bill and you are extremely right about it doing nothing against terrorism and only hurting innocent people. I wrote an article in my local newspaper just last week about this same thing.

I can only hope that people will stand up and tell them (senators, congressman, the president) that this is unacceptable. I have emailed and written every single senator and congressman and I will continue to do so.

Thank you for the great post.

The following link is the link to the newspaper article in the local paper where I live.
